WHY ATIKU CANNOT BECOME PRESIDENT IN FEBRUARY 2022
There has been a PR move by the former Vice President, Atiku Abubakar, to build up tempo and garner goodwill for himself towards the PDP Presidential primaries by reawakening the "Atiku Is Coming" Spirit.
The PR move being carried out by the Incorporated Trustees of the Civil Society Observatory for Constitutional and Legal Compliance (CSOCLC) takes the form of a lawsuit at the Appeal Court, seeking to remove Buhari as president and swear in Atiku on February 22, 2022.
The PR job which is being carried out by experts was designed with the knowledge that Nigerians are easily moved by sensational headlines and at the same time, lack the desire for details, since it's widely believed that in Nigeria, everything is possible, especially in a Fulani Presidency with a Tanko Judiciary.
As one in the same field, my job is to guess their plot and bring expose them.
First, their case bothers on Buhari's declaration before the Federal High Court in Abuja in 2014, challenging Buhari's certificate authenticity, stating that Buhari lied under oath as there is no organisation known as the Nigerian Military Board that Buhari said are with his certificates. So, they are saying that Buhari wasn't qualified to be sworn in as President and that Atiku, his runner-up should be sworn in.
Now, here are the NUMEROUS reasons why they have no case and will NEVER win.
1. The case was already concluded before the 2015 elections and was not appealed until Buhari was elected twice, therefore on those two occasions, he was elected legally.
2. After that case, Buhari provided a certificate (which many may doubt though but it doesn't invalidate it). After providing that one, WAEC then issued him a FRESH certificate. Therefore, the affidavit is no longer of any consequence.
3. Even if the appeal Court goes the Tanko Way, the case bothered on 2014 events in connection with 2015 elections. Therefore, if Buhari is disqualified on the bases of Certificate, the runner-up in 2015 election will be sworn in, not that of 2019.
4. The Supreme Court has ruled in the Atiku/Buhari election case, and the Supreme Court has laid a Judicial Precedent in the IMO State election case that the Supreme Court cannot overrule itself, even if their previous judgement was done in error.
5. Buhari wasn't elected with an affidavit but the fresh certificates he provided. If he can be convicted or anything relating to that, it would be for lying under oath. Till 2023, Buhari is the President and has immunity. So, none of those things can have any effect on him.
If all these are true, why is the news trending and why is the court hearing it?
Simple, it's a PR move that will raise tensions, hit the polity, make Atiku the dominant name in the polity and fix all attentions on him in the build up to PDP Primaries.
This will make people remember the Atiku is coming Mantra and make them start to see a better Nigeria with Atiku.
When the case is finally thrown out by the court as will surely be there case, Atiku will then stand on that high ovation to say that Nigerians are yearning for him to be their President and then formally declare his interest to become President and start off his campaign on a good footing.
Now you see? They are achieving their PR objectives though, but you should see the reality because you read from Zoba's Desk.
